Vivo CPR provides an IT platform through which industrial, governmental, public-private partnership, TWIC-regulated facilities, educational, healthcare, and other end users are connected with skilled, professional CPR, 1st Aid, and other mandated training certifications personnel. The privacy and security of our clients, trainers, and visitors are of paramount importance. Vivo CPR is committed to protecting the data you share with us. This privacy policy explains how we process information, collected through use of our website and IT platforms, that can be used to directly or indirectly identify an individual (“Personal Data”).

For the purposes of this policy, Vivo CPR defines the term “Client” as an entity with which Vivo CPR has an established relationship, whether or not formal or contractual, the term “Trainer” as any individual who registers with Vivo CPR to perform services for Clients through the Vivo CPR platform or who is included as a potential contact in our Trainer database, and the term “Visitor” as an individual that visits our front-end website or mobile platform.

Any information stored on Vivo CPR’s platform is treated as confidential. All information is stored securely and is accessed by authorized personnel only. Vivo CPR implements and maintains appropriate technical, security and organizational measures to protect Personal Data against unauthorized or unlawful processing and use, and against accidental loss, destruction, damage, theft or disclosure.

2. Collection and Use

  • General. The following sections cover the specifics of each of the three groups from which data is collected: website Visitors, Clients and Trainers.

  • Website Visitors. If you are a Visitor to our website or mobile platform only, and not a Client or Trainer utilizing our platforms, then this section is relevant for you.

    By visiting this website, you consent to the collection and use of your Personal Data as described herein. If you do not agree with the terms set out herein, please do not visit this website. If required by applicable law, we will seek your explicit consent to process Personal Data collected on this website or volunteered by you. Any consent will be entirely voluntary; however, if you do not grant the requested consent to the processing of your Personal Data, the use of this website may not be possible.

    Vivo CPR may collect, record and analyze information of Visitors to its website. We may record your IP address and use cookies. Vivo CPR may add information collected by way of pageview activity. Furthermore, Vivo CPR may collect and process any Personal Data that you volunteer to us in our website’s forms, such as when you register as a Client or a Trainer or to receive additional information or materials from us. If you provide Vivo CPR with your social media details, Vivo CPR may retrieve publicly available information about you from social media.

    Such Personal Data may comprise your IP address, first and last name, your postal and email address, your telephone number, your job title, data for social networks, your areas of interest, interest in Vivo CPR products, and certain information about your skills, certifications, levels of training, job experience, and the company you work for (company name and address), as well as information as to the type of relationship that exists between you and Vivo CPR.

    Vivo CPR gathers data about visits to the website, including numbers of Visitors and visits, geolocation data, length of time spent on the site, pages clicked or from where Visitors have come (links through other sites, etc.)

    • Purpose of Processing Personal Data. Vivo CPR uses the collected data to communicate with Visitors, to customize content for Visitors, to show ads on other websites to Visitors, and to improve its website by analyzing how Visitors navigate its website.

  • Trainers. Trainers should be aware that in accessing the Vivo CPR platform, they could be disclosing information that could make them personally identifiable to Vivo CPR Clients. The security and privacy protection implemented on Vivo CPR’s platform does not cover this type of transfer or disclosure of personal information. Trainers responding to requests for information, including availability, certifications, geolocation boundaries, skills and certifications, and job history should be aware that they alone are responsible for the content of their responses. For more detailed information concerning the protection of privacy when responding to requests for information on the Vivo CPR platform, Trainers or prospective Trainers may contact Vivo CPR.

    • Inquires. If you wish to inquire about your Personal Data that may have been collected in on the Vivo CPR platform, please contact us.

  • Clients.

    • General. In order to provide services to its Clients, Vivo CPR collects certain types of data from them. Except as required to connect the Client’s request with the appropriate pool of Trainers, data entered or transferred into Vivo CPR’s platform or databases by Clients such as texts, questions, contacts, media files, etc., remains the property of the Client and may not be shared with a third party by Vivo CPR without express consent from the Client.

    • Collection of Client Data. During a Client’s registration and later on Vivo CPR’s platform, information such as name, company name, email, address, telephone, credit card number and other relevant data may be provided. This information is used by Vivo CPR to identify the Client and provide them with support, services, communications, sales and marketing actions, billing and to meet contractual obligations.

      Vivo CPR Clients can at any time access and edit, update or delete their contact details by logging in with their username and password to Vivo CPR’s platform. It is the responsibility of the Client to be diligent in maintaining access to the Vivo CPR platform to those Client personnel with appropriate authority. Once a person accesses the Vivo CPR platform on behalf of a Client, such person meets the definition of Client in this policy. Vivo CPR will not retain Client data longer than is necessary to fulfill the purposes for which it was collected or as required by applicable laws or regulations.

      For Clients with corporate headquarters or chain of custody in the EEA, or for Clients providing information from the Vivo CPR platform to personnel in the EEA, the Client will be the “controller”, as defined in the Directive and the GDPR. The purpose will consequently be defined by Vivo CPR’s Client.

      If you or your organization are required under the European Union’s General Data Protection Regulation (GDPR) to enter into a contract, or other binding legal act under EU or Member State law, with your data processors, please contact Vivo CPR regarding applicable data processing requirements.

    • Geographical Location. Vivo CPR may offer a number of data regions from time to time. A Vivo CPR “Data Region” is a set of data centers located within a defined geographical area where data is stored. Personal Data may be retrieved and accessed from any Data Regions. Currently Vivo CPR processes data solely in data centers located in the US. Vivo CPR has adopted reasonable physical, technical and organizational safeguards which substantially mirror the safeguards enacted by the European Union against accidental, unauthorized or unlawful destruction, loss, alteration, disclosure, access, use or processing of the Client’s data in Vivo CPR’s possession. Vivo CPR will promptly notify the Client in the event of any known unauthorized access to, or use of, the Client’s data.

      All data collected by Vivo CPR Clients through the platform will be stored exclusively in secure hosting facilities. Vivo CPR’s contract with its hosting provider ensures that all hosting is performed in accordance with the highest security regulations. Vivo CPR’s policy is to protect and safeguard any personal information obtained by Vivo CPR in accordance with United States state or federal laws governing the protection of personal information and data. Accordingly, Vivo CPR adheres to practices and policies that aim to safeguard the data.

3. Retention and Deletion

Vivo CPR will not retain data longer than is necessary to fulfill the purposes for which it was collected or as required by applicable laws or regulations.

4. Acceptance of These Conditions

We assume that all Visitors of our website and Clients and Trainers accessing the Vivo CPR platform have carefully read this document and agree to its contents. A person who does not agree with this privacy policy should refrain from using our website and platform. We reserve the right to change our privacy policy as necessity dictates. Continued use of Vivo CPR website and platform after having been informed of any such changes to these conditions implies acceptance of the revised privacy policy. This privacy policy is an integral part of Vivo CPR’s terms of use.

5. Our Legal Obligation to Disclose Personal Information

We will reveal personal information without prior permission only when we have reason to believe that the disclosure of this information is required to establish the identity of, to contact or to initiate legal proceedings against a person or persons who are suspected of infringing rights or property belonging to Vivo CPR or to others who could be harmed by the user’s activities or of persons who could (deliberately or otherwise) transgress upon these rights and property.
